TERMS & CONDITIONS:

ADMISSION AGREEMENT (Version 17012101)

  1. This is an agreement containing all terms and conditions that are agreed to between iBOOKS Institute Pvt. Ltd. with head office at New Delhi or its associated companies/partners(as specified in the form), henceforth called iBOOKS, the applicant/student and his/her parent/guardian as mentioned in the application form herein and/or overleaf.

  2. The application form signed/filled up online by the applicant and/or his/her parent forms an integral part of this agreement.

  3. This shall remain effective from the date of admission till the end of the course in which the student is enrolled.

  4. Topics and/or headings wherever mentioned herein are only indicative and the detailed clause shall have to be read for all purposes.

    SECTION - I : GENERAL RULES / DISCIPLINE

  5. DISCIPLINE

    1. Absolute discipline(including timeliness) must be maintained within the premises of iBOOKS. No student is permitted to represent any other student for any matter whatsoever. Any student trying to do so will be asked to discontinue from the course.

    2. iBOOKS targets itself only to academic activities. Thus it does not undertake any other responsibility, including any occurrence(s) within or outside its premises involving the student.

  6. Parking of vehicles:

    1. Safe parking of cycle/two wheelers/vehicle is the absolute responsibility of the student himself / herself.

    2. iBOOKS will not be in any way responsible for any theft/loss/damage of/to cycles/two wheelers/vehicles inside/outside iBOOKS premises.

  7. Students are not permitted to use Mobile inside the premises of iBOOKS.

  8. iBOOKS reserves right to the following without assigning any reason

    1. To refuse admission to any candidate. If so, the amount paid (including the non-refundable registration expense), already paid by the student if any, will be refunded without interest by cheque/Account Transfer/to Scholarship card, as decided by iBOOKS.

    2. To cancel studentship at any point of time of coaching. If so, the residual amount calculated on pro-rata basis(this amount does not include the non-refundable registration expense), already paid by the student if any, will be refunded without interest by cheque/Account Transfer/to Scholarship card, as decided by iBOOKS.

    3. To regroup the student(s) at any point of time of coaching.

    4. To change class / class timing / subject teacher(s) at any point of time of coaching.

    5. To change the venue of classes to any place within the city/town limits/25 km radius.

    6. To use, for publicity or otherwise, any information (including applicant’s and/or parent's photograph) provided by the applicant through this application form, in anyway as necessary for iBOOKS or any of its associated companies.

    7. To frame new rules to be followed by the students.

    8. To add/delete/modify any or all portion of the syllabus of study during the tenure of the coaching period.

    9. To refuse discussion about anything related to the student with anyone except the student and the parent/guardian who sign this application. No power of attorney or authorisation in favour of any other person or representative of the student and/or the parent/guardian shall be entertained in any case.

    10. To discontinue anytime, a course (of one or more students), at its sole discretion, in which case the refund of amounts, if any, will be in accordance with the refund policy stated under SECTION-II.

  9. Hostels & Transport:

    1. At some branches iBOOKS may have its own/registered hostels and transport facility for which a separate form is to be filled up.

    2. At other places, wherever possible, iBOOKS may have only registered Hostels and Transport Owners. They give Hostel and/or Transport facilities to specifically the iBOOKS students. The Transports usually pick up students from the nearest specified pick-up points and not from home. They have their own rules and regulations. iBOOKS DOES NOT exercise ANY control over them.

    3. However, generally, iBOOKS aims to dedicate itself to academics only. So all the above facilities, whatsoever, are arranged from that perspective alone.

  10. Laptops/Mobiles/Tablet-PCs: In courses where a laptop/mobile/Tablet-PC are provided, the same shall be the property of iBOOKS till the end of the course. It shall be governed by the following additional rules:

    1. The student has to collect it personally or through my representative from New Delhi only.

    2. It may be lent to the student for use on ROR(Return or Retain) policy till the end of the course and the same must be used by the student carefully for purposes authorised by iBOOKS only. In case of damages, the cost of repair/replacement has to be born by the student himself/herself. There is no warranty on the same. In case of loss of the same, a replacement may be requested, which may be supplied (subject to availability) on payment by cheque/card of Rs 10, 000/- towards the cost of the same payable to the party supplying it to iBOOKS.

    3. ROR policy:

      1. Student is liable to RETURN the device at the end of course.

      2. Alternatively on completion of the course and completion of its full payments, whichever is later, the student may request the Chairman, iBOOKS to allow him/her to retain for its continued use, thereafter.

      3. iBooks may specify conditions for availing such permission.

      4. If the above request is approved by the Chairman, iBOOKS then the continued usage may be allowed or the laptop/mobile/Tablet-PC may be gifted to the student, as decided by the Chairman, iBOOKS.

      5. In case the above request is not approved then the laptop/mobile/Tablet-PC shall have to be returned to iBOOKS in proper working condition.

    4. The usage of Laptop/Mobile/TabletPC is allowed to the student to facilitate the studies only and no other purpose. In case of misuse of the same for purposes other than the one's allowed by iBOOKS, this facility shall stand withdrawn from the student and additional usage charges of Rs 250/- per day shall be levied for the previous period of possession of the device by the student.

    5. This device can be discontinued/model changed or provided to one student and not to another etc, and all such decisions shall be unchallengeable and shall be at the discretion of iBOOKS.

    6. Wherever a student is provided with such a device then the student shall be required to bring it whenever he/she enters iBOOKS premises.

    7. In case of discontinuation of the student from the course, for whatsoever reason, this device shall be returnable to iBOOKS by the student in perfect working condition within 7 days of such discontinuation, failing which iBOOKS may levy the above mentioned charges along with penalties and also may initiate legal actions.

    SECTION - II : PAYMENTS, Discounts & Scholarships details

  11. The student, taking admission shall have to pay One Time Administrative Non-refundable Expenses, henceforth called OTANE, including REGISTRATION EXPENSE/FEE, as a part of the entire payment for course, in the beginning itself, as these are expenses which are incurred by iBOOKS usually before/within the first 5 days of admission. Note that OTANE and Registration Expense/Fee are Non-refundable.

  12. Three schemes for payments towards course, excluding the OTANE, may be available(subject to permission): Standard Payment Scheme, henceforth called as SP, Discounted Standard Payment Scheme, henceforth called DSP, Equal Monthly Instalment Scheme with Rapid Admission Profile Interlinked Discount and/or Additional Discount, henceforth referred to as EMI, and Special Promotional Early Admission Discount Scheme, henceforth referred to as SPEADS.

  13. SP and/or DSP shall only be the available mode of payment unless or until iBOOKS specifically permits any student to opt to change to EMI or SPEADS, in writing. Any such option has to be exercised only at the time of admission.

  14. A student may opt to pay remaining dues anytime by way of One Time Payment, henceforth called as OTP, subject to permission from Chairman, iBooks. The OTP option shall be governed by following rules:

    1. A written application shall have to be made by the applicant and/or his/her parent/guardian for this.

    2. iBOOKS may/may not grant permission to pay by OTP mode.

    3. In case the permission is granted then the amount payable shall be the entire remaining amount.

    4. An OTP Option Charge may be levied.

    5. iBOOKS, at its discretion, may/may not provide any additional discount called OTP discount for paying by OTP, which can vary from time to time.

    6. In case of OTP, refund shall be subject to the refund rules specified in this agreement.

  15. In case of revision/imposition of service and/or other taxes, at a later date, leviable to the student by the Central/State Government or other regulatory bodies / agencies, the same shall be borne additionally by the student, after such announcement. In case of OTP (along with Registration expense/fees) also the proportionate extra amount, if any, to be paid to the Central/State Government or other regulatory bodies / agencies, arising out of such imposition/revision of service and/or other taxes, shall have to be paid by the student to iBOOKS within the stipulated time period.

  16. Refund in case of OTP:

    1. Refund may be permitted on permanent discontinuation of course (including cancellation of studentship, as given in this agreement). For refund, the student shall have to fill up “Application For Refund” (AFR).

    2. An OTP Cancellation Charges shall be levied. Unless specified separately this shall be Rs25,000/- (Rupees Twenty Five Thousand only)

    3. Amount Refundable in OTP scheme: Refund amount = Amount actually paid by student – OTANE –OTP option charges(irrespective of it being waived off or not) OTP Cancellation Charges – Total amounts payable under SP scheme, till and including the month in which “Application For Refund” is made) – Scholarship already paid, if any – Applicable taxes. Note that OTANE and Registration expense/fee are Non-refundable.

  17. Important Points for SP/DSP/EMI/SPEADS:

    1. The instalments are NOT Monthly tuition fees. The only purpose of Instalments in SP/DSP/EMI/SPEADS is to make the payments for course, easy for the student. Thus all the instalments shall have to be paid even if the student absents for any duration and for any reason whatsoever, during the course period or even discontinues or fails to take action as per the clause given above. The amount is a total payment for the course package since the admission of the student is into the complete course package(s) which cannot be opted for in parts.

    2. The due date of the instalments shall be first day of the corresponding month.

    3. Delay in payment of instalments: A late payment charge of Rs 40/- per day of delay after the due date, shall be levied for a maximum of 14 days(that is till 15th of the month). Beyond that, the names of students who have not cleared the dues, shall be will be struck off rolls and shall amount to their permanent discontinuation from the course.

    4. Grace period: As a grace period, the late payment charges upto a delay of maximum 5 days, that is upto 6th of the corresponding month of instalment, may be waived off upon request by the student/parent.

    5. Re-registration: Re-registration is not permitted. However upon written application, the Chairman of iBOOKS, at his absolute discretion, may permit re-registration on payment of “Re-registration expense/fee” of Rs 2500/- plus taxes along with previous outstanding payments, if any.

    6. An instalment, once paid, shall NOT be refundable except when a student is refused admission.

  18. Scholarships:

    1. iBOOKS may frame rules for payment of scholarship to students from time to time.

    2. This scholarship is currently in terms of points which can be redeemed as money.

    3. Students who complete the course shall alone be eligible for scholarships.

    4. Scholarship is given by iBOOKS at its own initiative and out of its own fund. Thus Scholarship rules and its continuity shall be at the absolute discretion of iBOOKS. In case of any confusion as regards Scholarships or associated points, the decision of the Chairman of iBOOKS shall be final.

    5. Any applicant and/or his/her parent/guardian shall NOT claim any payment of Scholarship from iBOOKS under any circumstance.

  19. Discounts:

    1. iBOOKS may provide discount based on various parameters decided at its own discretion. Sometimes it may also be given whenever a student procures the relevant study materials/books on his/her own. The decision of iBOOKS shall be final and no one must claim any discount as a matter of right.

    2. Eligibility for discounts, if any, shall be available only to students who complete the course, irrespective of when the amount is adjusted from payment.

    3. Additionally the student seeking the discount will have to fill up “Mandatory New Reference” form and provide to us its mandatory number of new references of prospective students who have not been referenced by any other student, as per. All such references may need to be verified before being accepted.

    4. In case of SP/DSP/EMI/SPEADS, all discounts, if any, shall be adjusted from the last instalments.

    5. In case of OTP all discounts, if any, shall be adjusted at the time of payment of OTP amount.

    6. Whenever a student is eligible for more than one discount, only one discount, whichever is highest, may be applicable.

    Section - III : PAYMENT MODE

  20. All amounts once paid SHALL NOT BE REFUNDABLE except only and only in case of OTP which shall be governed by refund rules specified in this agreement.

  21. All payments shall have to be done through online payment via our website/app or through ECS/Direct Debit mandate / local CTS cheque/DD/Credit or Debit card swiping only.

  22. All cheques/DD must be drawn in favour of iBOOKS Institute Pvt. Ltd. or the associated company, as specified in the form, payable at a city where a branch of iBOOKS is situated which are presently(at the time of printing this application form), New Delhi, Bhubaneswar, Berhampur & Cuttack only.

  23. Normally Cash payment shall be permissible rarely with prior approval and that too only in case of instalments, by making additional payment of cash handling charge of Rs 2,000/- plus taxes per transaction.

  24. A cheque/DD/NEFT handling charge of Rs 250/- shall also be levied on every payment made by cheque or DD or NEFT.

  25. If a cheque/DD is dishonoured, for whatsoever reason, the amount shall be paid by the student/parent, only by card swiping/online payment/cash along with an additional amount of Rs 2,000/- for each cheque/DD dishonoured, within 3 days of the date of dishonouring of the cheque/DD, failing which suitable legal action may be initiated by IBOOKS. Such dishonoured cheques shall be cancelled in front of the parent/guardian/student and kept at iBOOKS for record purposes. However in case of DDs, the same shall be handed over to the student only after the receiving all the payments stated herein.

  26. Post-dated cheques (which amount to delay in payment), outstation cheques and cheques not complying with latest banking guidelines shall be treated as dishonoured cheques. Every such post-dated cheque or outstation cheque, though deposited by chance and received by the staff, shall be treated as dishonoured cheque and the outstanding amount,if any, along with additional payment of Rs 2,000/- shall be payable only by card swiping/online payment/cash within 3 days of the date of payment by such cheques failing which suitable legal action may be initiated by iBOOKS.

  27. Students/parents must carefully write out the following at the bottom right corner of the back of the cheque/DD, in a manner such that the cheques/DD shall not get dishonoured for reasons of tampering/clarity : (1) Roll No. and Name of the student and (2) Course applied for / Month of the instalment.

    SECTION - IV : Loss OR DAMAGE of Identity Card AND CHANGE OF STREAM or course

  28. An Identity Card, also called as I-Card shall be issued to the student. Once it is issued, students without I-Cards, shall not be permitted inside the premises. Till such time the student has to use the receipt.

    1. Reissue of I-card, if lost, may be permitted on a non-refundable payment of Rs 600/- + Tax.

    2. However such reissue shall be permitted only once. If the I - card is lost or damaged for the second time, no reissue shall be permissible and that shall amount to violation of clauses of this agreement by the applicant and his parent/guardian.

    3. The I-Card being the property of iBOOKS may be revoked by iBOOKS at anytime.

  29. A stream or course of study (i.e. Engg or Med or JEE/AIIMS/NEET or any other STREAM wherever applicable), once opted by a student in writing/online in his/her Application Form, shall be taken as final and no change shall be allowed there-after. However in rare cases, if possible, a student may be allowed to change his/her STREAM on payment of STREAM/COURSE CHANGE-OVER charges of Rs 1,500/-. In addition, the student shall pay the cost of the study materials (of the new Stream/course) supplied at the time of such change-over.

    SECTION - V : OTHER TERMS & CONDITIONS

  30. Access of the student and/or his/her parent/guardian to various areas/parts within iBOOKS premises shall be subject to rules and regulations of iBOOKS prescribed from time to time.

  31. The student shall take care of himself/herself and shall remain responsible for his/her safety within the premises of iBOOKS. The applicant and his/her parent/guardian hereby indemnify iBOOKS of any mis-happenings, if any within or outside the premises of iBOOKS.

  32. The applicant and his/her parent/guardian shall not be involved in any illegal or anti-social activity in the past or at anytime during the period in which this document is valid.

  33. The applicant and his/her parent/guardian shall take all care to uphold the name, goodwill and brand of iBOOKS and depict a warm relation with iBOOKS in the eyes of the public at all times and at all costs.

  34. Non disclosure of data : The applicant and his/her parent/guardian shall not use or disclose the data, information, system of study etc gained during the conduct of course including data of students and faculty, if any, to any other person/entity/organisation which is in a similar field as that of any companies of iBOOKS Group of companies, for a period of at least 12 months from the date of discontinuation of this agreement, caused due to violation of any of the clause of this agreement by the applicant and his/her parent/guardian or otherwise.

  35. In case of difference of opinion : All other related matters of difference of opinion, not stated in this Agreement, would be interpreted as decided by the Chairman of iBOOKS..

  36. The agreement, given herein, is in addition to the agreement(s), if any, signed earlier. In cases of conflict/doubt/confusion between any clause of the agreement, given herein, and other agreement(s), if any, signed on a date prior to the date of signing the agreement, given herein; then the agreement, given herein shall take precedence.

  37. The student shall abide by all present & future rules/decisions of iBOOKS which are of academic and administrative in nature.

  38. Disputes and Arbitration: In case of disputes and legal matters related to the course, the functioning of iBOOKS or interpretation of this agreement, or otherwise, the matter shall be referred to a sole arbitrator appointed by Chairman of iBOOKS, before taking such matters to courts.

    1. Such arbitration proceedings shall be held at New Delhi only.

    2. No person/authority shall have a right to take any matter to a court/any tribunal without first resorting to arbitration.

    3. Provisions of Indian Arbitration and Conciliation Act 1996 shall be applicable to such arbitration.

  39. All disputes and legal matters related to the course unresolved by the arbitration process, referred to above, if any, shall be subject to the EXCLUSIVE jurisdiction of courts and/or forums located at New Delhi (India) ONLY. This is unconditionally and irrevocably agreed to by both iBOOKS and the applicant & his/her parent/guardian.

    1. In case a need to refer to consumer forum arises then it is irrevocably and unconditionally agreed to refer the matter to the consumer forum at New Delhi alone, irrespective of the applicant or his/her parent/guardian residing at New Delhi.

    2. No other courts or forum or statutory dispute resolution bodies other than the ones situated at New Delhi shall have jurisdiction over the matters/disputes, if any, arising out of this agreement.

  40. Bar against legal proceeding: No court of law and/or tribunal including but not limited to Consumer forum shall be ever approached by the student/parent to take cognizance of anything/matter for any legal action against iBOOKS or any staff or employee or its associated companies without the complainant and/or aggrieved party first having resorted to arbitration as provided vide arbitration clause above and with approval of the Chairman of iBOOKS.

  41. Violations of any of the above mentioned terms & conditions shall lead to cancellation of this agreement and will entitle iBOOKS to claim any damages/expenses incurred due to such violation & subsequent cancellation procedures, from the applicant and/or his/her parent/guardian.

    SECTION - VI : UNDERTAKING BY THE APPLICANT AND HIS/HER PARENT/GUARDIAN

  42. I know that this course demands that I purchase a legal copy of the latest edition of the prescribed books/study materials and mandatory devices, if any, specified for the course. I promise to comply with this requirement failing which I am liable to be dismissed/debarred from the course and my registration expense/fee may be forfeited.

  43. I request iBOOKS to please issue me the necessary text books for the course opted for by me. I shall pay for the same along with the payments (although it is billed separately). If iBOOKS informs me in writing to pay the price for such text books/workbooks directly to some other entity including but not limited to publisher/distributor etc then I shall do the same. In case I procure the genuine copy of the study materials/books then iBOOKS, at its sole discretion, may or many not decide to give me a matching additional discount.

  44. I request iBOOKS to make payments, if any, on my behalf to external parties/entities including but not limited to organisations like CBSE/CHSE/ISCE/Government of India/any other government authorised examining/certifying body/schools/colleges etc. in relation to the course opted for by me. I undertake to pay to iBOOKS all such payments made by iBOOKS on my behalf to any external agency/party.

  45. I request iBOOKS to allow me to use the address of iBOOKS premise where I am taking admission for providing to external parties/entities including but not limited to organisations like CBSE/CHSE/ISCE/Government of India/any other government authorised examining/certifying body/schools/colleges etc. in relation to the course opted for by me.

  46. I request and authorise iBOOKS to fill up necessary forms on my behalf to facilitate the completion of the course opted for by me. However, I know that the decision to accept my requests or not shall be at the sole discretion of iBOOKS.

  47. I/we undertake not to instruct my/our bankers for stop PAYMENT of any of my/our cheques paid to iBooks. If I/we do so, for whatsoever reason, I/we will be legally liable to pay by cash to iBooks the amount of my/our cheques along with an additional Rs 15,000/- within a period of 3 days of issue of STOP PAYMENT instruction to bank. I know and accept that on my/our failure to do the payment, iBooks is entitled to file a legal suit against me/us to recover the amounts stated above along with other incidental compensations, which shall be at least Rs 50,000/-.

  48. I/we undertake not to dispute/refuse to my/our bank/credit card company, any transaction made on our credit/debit card towards payments for the course to iBooks, as per the payment option, mode & scheme mentioned & accepted by me here in this form. I know and accept that on my/our failure to do so, iBooks is entitled to sue me/us to recover the amounts stated above along with other incidental compensations, which shall be at least Rs 50,000/-.

  49. I am aware that the schemes of EMI, SPEADS and OTP have been made to help us to avail of some discounts and in turn also put restrictions on my options of refund, if I discontinue from the course in between. I also know that iBOOKS encourages only instalment method of payment and selectively gives permission for SPEADS / OTP. Opting for SPEADS / OTP schemes have been our own personal decision being aware of their pros and cons very well.

  50. Certified that in case of payment by credit/debit card, the card member will be the person responsible for bearing my child’s/my educational expenses at iBooks.

  51. Certified that the data furnished by me/us on the application form are true to the best of my/our knowledge and that the applicant is eligible for the Test for which this coaching course is meant.

  52. Certified that I/we have read carefully, understood the contents, accept and undertake to abide by each and every clause stated above and the other existing rules/regulations of iBooks. Also certified that I/we have kept a photocopy of all pages of this Agreement and Application Form for my/our future reference.

  53. Certified that I am aware that the courses of iBOOKS provide coaching and hence do not need any affiliation/accreditation/recognition from any university or state/central board/ any regulatory body.

  54. Certified that I am aware that student's performance in the exams is entirely dependent on student's preparation and student's usage of the coaching provided by iBOOKS, hence I unconditionally and completely undertake its entire responsibility and indemnify iBOOKS of any consequences related to it.

  55. Certified that I am taking admission after having thoroughly personally verifying and satisfying in details myself about this course, its validity, effectiveness, rigour involved, pre-requisites, terms & conditions etc instead of just relying only on the advertisements etc. Hence, I also declare that I shall not hold iBOOKS responsible for any issues/disputes arising out of inadvertent/unintentional omission or commission by iBOOKS or its staff in this regard.

  56. I/we also know that the payment(s), once paid either by card or cash or cheque, is/are not refundable/adjustable under any circumstance including cancellation of studentship of iBooks, if any, except in cases of OTP which shall be governed by refund rules as mentioned in this agreement.

  57. I declare that by the very act of using, for the first time, any of the features of the course, irrespective of my physically signing the application form/admission agreement or my filling the same online, I give my complete and unconditional consent to abide by this agreement.

  58. Certified that I am competent and have appropriate authority to sign and be a party to this agreement.

  59. I have understood that in case of disputes including but not limited to any disputes in any courts of law, if any, arising out of this agreement and the studentship of the applicant at iBOOKS, the courts and/or tribunals at NEW DELHI ALONE shall have EXCLUSIVE JURISDICTION and shall be approached only after arbitration proceeding, as specified above.
